Brief: 

The brief argued that violence that inflicts physical injury is not the sole conduct that could create a risky and harmful environment for a child. Record of Petitioner’s red-faced screaming, increasingly violent outbursts, and efforts to achieve total control over the lives of mother and child showed that he created an environment that was abusive and damaging to the child, whether or not the child was the direct target of the abuse or was exposed to it. It was believed that the infant child should not be returned to live with his father due to the high possibility of future physical and psychological harm from the Petitioner.
